PlowProof Terms of Service

1. Accounts and eligibility

PlowProof supports company (subscriber) accounts and contractor/worker accounts invited by a company. You must provide accurate registration information and keep credentials confidential.

Company administrators are responsible for authorizing users, assigning roles, and ensuring their team’s compliant use of the service.

New company subscriptions and plan selection are completed on https://plowproof.app. Mobile apps are intended primarily for returning users to sign in and perform field work.

2. Subscriptions and billing

Paid plans, renewals, upgrades, and cancellations are governed by the pricing and checkout flow presented at signup or in billing settings. Fees are non-refundable except where required by law or expressly stated at purchase.

Failure to pay may result in suspension or termination of access. Taxes may apply based on your billing location.

3. License and acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable license to use PlowProof for lawful snow/ice and related field-service operations for your organization.

• Do not reverse engineer, scrape, resell, or misuse the service.
• Do not upload unlawful, infringing, or deceptive content.
• Do not attempt to bypass security, access another organization’s data, or disrupt service availability.
• Do not use location, camera, or proof features to harass individuals or violate workplace or privacy laws.

4. Your content and operational records

You retain ownership of customer, job, photo, and other business content you submit. You grant us a license to host, process, display, and transmit that content solely to provide and improve the service.

You represent that you have the rights needed to submit that content and that your use of GPS, photos, and worker data complies with applicable employment and privacy laws.

5. Proof photos, GPS, and timecards

Proof-of-work photos, GPS stamps, maps, and timecard records are tools to document operations. They do not guarantee particular legal, insurance, or dispute outcomes. You remain responsible for how your organization interprets and relies on those records.

6. Third-party services

If you connect third-party services (accounting, maps, notifications, OCR, payments), their terms and privacy policies also apply. You can disconnect integrations where the product provides a disconnect control.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK ELEVEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK ELEVEN AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

Our aggregate liability arising out of these Terms or the service will not exceed the amounts you paid to us for the service in the twelve (12) months before the claim, or one hundred U.S. dollars (US $100) if you have not paid fees.

9. Indemnity

You will defend and indemnify Peak Eleven against claims arising from your content, your team’s use of the service, or your violation of these Terms or applicable law.

10. Suspension and termination

We may suspend or terminate access for non-payment, abuse, legal risk, or material breach. You may stop using the service at any time. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

11. Changes to the Terms

We may update these Terms periodically. Material changes will be reflected by updating the “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law.
